Recent changes in the law

In 2005, the Illinois legislature enacted large-scale changes to the state's workers' compensation system.

Among the changes in the law were:

  •  Permanent partial disability (PPD) and death benefits were increased.
  •  A medical fee schedule was established to set a maximum allowable charge for  medical treatment for work-related injuries or illnesses.
  •  A utilization review program was established whereby an employer may seek  review of any past or proposed medical treatment to determine whether it is (or  was) medically reasonable and necessary. The employer may submit a utilization  review into evidence in hearings before the Commission in the same manner as  other evidence.
  •  For non-disputed medical expenses, an employer is now required to pay the bill  within 60 days.
  •  For disputed medical expenses, the medical provider may not bill the employee  while the workers' compensation claim is pending.
